Although the empty court seats due to the absence of a judge is considered one of the main factors in delaying the proceedings; But other important factors caused the delay of proceedings And it puts the burden of dealing with numerous judicial cases on the shoulders of judges who, despite having the knowledge, expertise and necessary conditions for quality proceedings, are forced to speed up the proceedings in such a way that they sacrifice the quality of the proceedings for the speed of the proceedings. مستند به اصل یکصد و پنجاه نهم قانون اساسی: «مرجع رسمی تظلمات و شکایات، دادگستری است». افراد، دادخواهی خود را به محاکم دادگستری تقدیم نموده و رسیدگی عادلانه، مورد انتظار عامه است. لیکن در برخی موارد، روند دادرسی به حدی طولانی می¬گردد که روال پرونده فرسایشی می¬شود. از یکسو اشخاص با استناد به اصل سی و چهارم قانون اساسی، دادخواهی را حق مسلم خود دانسته و از سوی دیگر اطاله دادرسی را موجب تضییع حقوق خود قلمداد می¬کنند. هر چند که خالی بودن کرسی¬های دادرسی به دلیل عدم وجود قاضی، از عمده¬ترین عوامل اطاله دادرسی محسوب می¬گردد؛ لیکن عوامل مهم دیگری موجبات اطاله دادرسی را ایجاد نموده و بار رسیدگی به پرونده¬های بیشمار قضایی را بر دوش قضاتی تحمیل می¬کند که با وصف دارا بودن علم، تخصص و شرایط لازم برای دادرسی با کیفیت، مجبور به تسریع در رسیدگی شده به نحوی که کیفیت رسیدگی را فدای کمیت دادرسی می¬نمایند. https://www.hljr.ir/downloadfilepdf/246349
